The stated purpose of Bill 19-717 is to extend the statute of limitations for a wrongful death claim from one year to two years. The District is one of only four jurisdictions that still has a one-year statute of limitations for wrongful death, while a majority of states has a two-year statute of limitations for wrongful death actions. Of relevance, the District allows a plaintiff three years to bring a personal injury lawsuit. The Committee invites testimony as to the benefits and costs of changing the wrongful death statute of limitations from one year to two years.
